1.General/Validity
These terms and conditions underlie all deliveries and accomplishments of Sourkrauts Onlineshop. Derogations and/or supplementary agreements require an explicit written consent of Sourkrauts Onlineshop. An approval as mail is acceptable.
2. Offers
All offers within Sourkrauts Onlineshop on the website www.Sourkrauts.de are non-binding and without obligation. Small deviations and technical changes towards our images or descriptions are possible. The contract is going to be achieved with the completion of the order on the webpage of Sourkrauts Onlineshop and with the confirmation of the order via email from Soukrauts Onlineshop or with the completion of the order by Sourkrauts Onlineshop.
3. Prices and payment terms
All prices listed on the webpages of Sourkrauts Onlineshop are subjects to confrimation at the time of order. All named prices are final prices and shall be in Euro (EUR) and include statutory VAT (currently 19%) plus shipping and handling. Sourkrauts Onlineshop accepts all method of payments as shown on the webpages of Sourkrauts Onlineshop during the process of order. The costumer chooses the method of payment by himself. COD is going to be charged (applies only to cash on delivery orders). A clearance of mutual demands requires an explicit written consent of Sourkrauts Onlineshop.
4. Delivery, delivery time and shipping costs
All deliveries are going to be supplied by a third party-supplier (delivery service) named during the order process. The costumer chooses the method of shipment by himself. Shipping costs will be announced to the costumer before the order is complete. Products in stock will be sent within 1-2 weeks after payment. Out of stock products the delivery could need up to four weeks after order. For possibility of delivery Sourkrauts Onlineshop is dependent on seasonable arrival of their products. Does the delivery fail in case of reasons without substitutions of Sourkrauts Onlineshop so Sourkraut Onlineshop could withdraw from the contract. Soukraut Onlineshop commits to inform the customer as soon as possible about this situation. Eventual Payments in advance will be refunded immediately. In this case there will be no right for the customer to claim Sourkrauts Onlineshop for damage. Partial deliveries are acceptable, as long as the customer doesn´t show to be uninterested or it would be recognizable unaccepting. In this case the costs for shipping and handling will only be charged once.
5. Instruction to exchange and return policy
All items purchased at Sourkrauts Onlineshop can be returned, within two weeks of receiving the product, without giving any reasons. The period begins with the date of invoice and this instruction. During this period it is sufficient to send the product
The right of restitution (§ 312 IV BGB) exists excluding unsealed audio, video or software media or products which have been manufactured according to customer specifications (for example products that need to be specially ordered). Payments made by the contractor within 5 working days of receiving the returned products made ??by bank transfer to a customer account to be named in Germany.
The return must be sent to the business address above.
Up to a value of 40 €, the return is at risk and expense of the customer. The return costs from an order of 40 € will be taken over by Sourkrauts Onlineshop. The return must be postage stamped properly. The postage costs for returning (based on the best possible shipping method of Deutsche Post AG) will be redeemed per bank transfer to an account that have to be named in Germany. Do additional costs occur Sourkrauts Shop by insufficient postage for the return, they will be charged with any payments made by the customer.
Sourkrauts Onlineshop reserves a claim for compensation for damaged products extended. If the customer has any deterioration, loss or other impossibility, so he has to replace the reduction in value, § § 351 and 353 BGB shall not apply. The return of the merchandise must be in original packaging. If this is not possible, the customer has to ensure a packaging that prevents damage to the product. The customer is liable for damage to the product which is due to poor packaging.
Unstamped products will be refused and returned to the customer promptly.
Obvious defects (in particular damages, wrong deliveries or deviations in quantity), shipping damage or other defects Sourkrauts shop must be informed immediately or at least within 14 calendar days in written form after receiving the product. The notification by email to info@Sourkrauts.de is sufficient.
6. Passage of risk (does not apply to any insurance policy)
The products are delivered at customers risk. The risk of the delivery goes over to the customer by handing it out to the carrier. That even applies if the shipment was paid by Sourkrauts Onlineshop Complaints due to damage (for example damaged packaging prior to receive of the product) have to be claimed by the customer directly to the shipping company within the specified period of time.
7. Warranty
At the time of transfer Sourkrauts Onlineshop guarantees that the products that are sold are free of risk in materials and workmanship and do have the contractually assured characteristics. It shall be deemed the statutory warranty period of two years from date of invoice. The warranty does not cover operational wear and normal deterioration. Customer claims for damages, for example because of default, negligence of contract, breach of secondary contractual obligations, consequential damages, damages for tort and other legal reasons are excluded. Sourkrauts Onlineshop is liable in case of absence of a guaranteed quality, willful misconduct or gross negligence. Claims under the Product Liability Act are not affected. If defects occur, that Sourkraut Onlineshop has to represent, or in case of the delivery of a replacement product that´s still defective, the customer has the right to change or decrease. Sourkrauts Onlineshop accepts no liability for the continuous and uninterrupted availability of www.Sourkrauts Online Shop or for technical or electronic errors of the online service.
8. Retention of title
All deliveries are subject to retention. The delivered products are the property of the Sourkrauts Onlineshop until full payment of the purchase price.
9. Data storage / data protection
According to § 28 BDSG (Federal Data Protection Act) we would like to inform you that in the context of business data required to be processed and stored by a computer system in accordance with § 33 BDSG. All personal data collected from the customer will be kept confidential. Exclusively in the context of order processing (Payment, shipping), the necessary data will be used towards third parties. You can get free information about the storage of your data anytime. According to this please send an email to info@sourkrauts.de Onlineshop. For privacy reasons, the answer can only be send to the email you placed at Sourkrauts Onlineshop.
10. Place of jurisdiction
Jurisdiction for all disputes related to the delivery business, is the extent compatible with the jurisdiction of Sourkrauts Onlineshop. The seat of Sourkrauts Onlineshop is the place of jurisdiction for the case the other party has no general jurisdiction in Germany or the contractor transferred his residence to a foreign country after the contract or the residence of the contractor at the time of filing the action is not known. The parties agree to practice all legal relations arising from this contractual relationship by the law of the Federal Republic of Germany excluding the UN sales law.
11. Additional provision
The invalidity or unenforceability shall not affect any provision of these Conditions of the validity of the remaining provisions. Void or invalid conditions are replaced by the law. 10/2009
